The extension of beach concessions must not be applied, as the Council of State reiterated with a sentence that stops the automatic extension of state licenses, foreseen until the end of 2024 by the Milleproroghe decree.
The Administrative Magistrates explain that the extension is in direct conflict with the Bolkestein directive and must therefore be disapplied by any state body.
“The rules that provided for the automatic extension of beach concessions are in conflict with article 12 of the European Directive and therefore must not be applied”, writes the Administrative Justice in its ruling against a decision by the municipality of Manduria in Puglia to extend maritime state concessions until 2033.
The doubts expressed by the Quirinale regarding the compatibility of the extension with European law also weigh on the provision, also due to the market opening commitments undertaken with the Pnrr.
The Council of State, which had already expressed itself with two sentences - in 2021 - once again reiterates the impossibility of further extensions.
The confirmation of a non-secondary problem of a Government, the President of the Republic Mattarella had already intervened on the extension in conflict with European legislation, who by promulgating the 'Milleproroghe' had reminded the Government on the seaside issue, on which Italy risks the procedure of infringement by Brussels.
