Brescia, the environmental compatibility judgment of the La Castella landfill was cancelled

Brescia, The Council of State accepted the appeal of the Municipality of Rezzato and annulled the positive environmental compatibility assessment relating to the La Castella landfill, reforming the sentence of the TAR.

A historic result, which rewards the work and commitment carried out by the Administrations of Brescia, Castenedolo and Borgosatollo, which had resorted to the same ad adiuvandum. A result that rewards the mobilization of the associations, the CdQ, the CO.DI.SA and the citizens.
The appeal judge therefore shared the doubts of all the bodies involved regarding the insufficient evaluation of the harmful effects and critical issues linked to the location of the landfill, also in correlation with the previous denial, already expressed by the Region, for theCastella 1 plant.

Furthermore, it considered the option of the so-called "zero alternative", i.e. not building the plant, to be inadequately explored. According to the ruling, in fact, in order to be able to express a positive judgment of environmental compatibility it is not sufficient for there to be technical elements that generally do not hinder the location, but it is necessary for the competent authority to take into account the effects of the location of the plant on the surrounding area and on its recovery and rehabilitation prospects.

The Province, therefore, will have to reopen the investigation and resume the procedure from the beginning: in light of the sentence, it will have to express its opinion on the real need to place a landfill in an area that the judges define “already seriously affected at an environmental level and subjected to highly impacting risk and pressure factors".
This sentence confirms that our Administration, by implementing environmental compensation interventions in this area, has taken the right path, especially with the cessation of mining activity and the creation of the Quarry Park.

In fact, it is an area that, in environmental terms, has already paid a very high price in the past.
Furthermore, applause must be given to the citizens of Buffalora who, with tenacity and courage, have carried out this great battle over the years and who today finally see their reason recognised.
