It's the first time this has happened: the Presidency of the Council of Ministers will not be a civil party in a trial for the Piazza della Loggia massacre in Brescia.

The government was excluded as a civil party from the new proceedings. During the preliminary hearing against Roberto Zorzi, the preliminary hearing judge rejected the application of the Presidency of the Council of Ministers as a civil party, who had submitted the application late compared to when the hearing began on March 23rd.

The preliminary hearing judge accepted the objection of the defendant's defense who opposed the late constitution of Palazzo Chigi. For the judge the Presidency of the Council "he could not have known about the start of the hearing and therefore cannot ask to enter late".

It's the first time, in all the proceedings for the attack on May 28, 1974, that the State will not be legally present.

"The decision of the Gup of Brescia to deny the constitution of civil party proposed by the State Attorney's Office for the Presidency of the Council is surprising – reads in a note from Palazzo Chigi -. The Presidency of the Council was thus prevented from exercising the power-duty of supporting the defense of the victims. The State Attorney's Office has been instructed to appeal to the Supreme Court against such a clearly abnormal measure".
