Catania, prohibition issued to approach the injured party for the crime of mistreatment in the family

The Public Prosecutor's Office, as part of an investigation into a 40-year-old from Catania, investigated for the crime of "mistreatment in the family", he requested and obtained from the GIP of the Court of Catania the application of the precautionary measure of the prohibition of approaching the injured party, carried out by the Carabinieri of the Ognina Station.

The facts that gave rise to the issuing of the restrictive measure began following the complaint filed by the injured party, a thirty-eight-year-old from Catania, who reported the repeated physical and psychological violence she had suffered at the hands of her spouse.
The incidents of mistreatment, characterized by insults and aggression, also reportedly occurred in the presence of the couple's two minor daughters.

The woman, exasperated by her husband's obsessive jealousy, had already initiated legal separation, however, the man's persecutory behavior continued despite this.
The episode that would have pushed the victim to turn to the military of the Ognina Station would have occurred upon her return from an evening spent with friends. On that occasion, in fact, her husband would have attacked her with slaps to the face and serious insults.

The attack apparently ended only thanks to the intervention of the eldest daughter, who intervened to protect her mother, managing to stop the man and interrupt the violent act.

Furthermore, Despite the separation, the man continued to seek physical contact with the victim, even forcing her against her will to satisfy his requests, a further serious fact that aggravated the already critical situation.
A few days later, the victim provided further evidence to support her complaint, presenting the Carabinieri with the messages received from her husband on his cell phone. These messages, in addition to reinforcing her statements, were presented as concrete and incontrovertible evidence of the man's threatening behavior. In them, the suspect, having learned of an appointment between the victim and her former schoolmates, allegedly intimidated her with explicit threats, writing: "I'll sit at the next table! Tomorrow you'll see him... tomorrow..." and again: "It's war! You asked for it. If they arrest me, you're lucky!"

In light of the information gathered and the repeated conduct of the suspect, this Prosecutor's Office requested and obtained the application of the precautionary measure of prohibition of approaching the injured party, in order to protect the safety of the victim and guarantee the safety of the family context.
