At the first light of dawn, the agents of the Flying Squad of the Bari Police Headquarters carried out a precautionary measure in prison, issued by the Judge for Preliminary Investigations at the Court of Bari, at the request of this Public Prosecutor's Office, against the alleged perpetrator of the murder of physiotherapist Mauro Di Giacomo, committed in the Poggiofranco district of Bari on the evening of December 18th.
Dr. Di Giacomo, a well-known and esteemed professional, worked at the Policlinico of Bari and in a private practice, near via Amendola. On the evening of December 18, at approximately 20.25:XNUMX p.m., after finishing his professional activity in the private practice, he drove his car to his home, located in via Tauro, and parked. The hitman was there waiting for him. She approached him, and after a brief altercation, she exploded at him 7 gunshots, 7.65 mm caliber, drawing him with 5 bullets, after which he attacked the victim, hitting him several times on the head with the butt of the gun.
Having completed his murderous intent, the killer drove away at full speed in a black small car, losing track of himself.
With the necessary premise that these are investigations carried out in the preliminary investigation phase, which require subsequent procedural verification in cross-examination with the defense, the investigations, coordinated by this Public Prosecutor's Office, conducted by the Crimes against the Person section of the Bari Flying Squad, focused, among other things, on hearings of a plurality of witnesses, including eyewitnesses, on the examination of video surveillance images and traffic, telephone and electronic records, acquired, and on a series of technical findings.
As a result of a detailed and meticulous development of the investigative findings acquired, a well-defined circumstantial framework was outlined against a 59 year old from Canosa di Puglia, construction worker, with no criminal record, for whom handcuffs were imposed, in execution of an arrest warrant pre-trial detention in prison.
One of the suspect's daughters, in 2020, filed a civil lawsuit against the victim, for professional liability, accusing him of having caused permanent personal injury, during a physiotherapy session, which took place in September 2019.
Di Giacomo, who appeared in the trial, had denied his responsibility, as well as his willingness to reach any form of settlement.
The incident caused the suspect to feel resentment and resentment towards the physiotherapist, until, on the evening of December 18, after some inspections carried out in the previous month of February, he would have carried out the premeditated murderous intention.
To the alleged perpetrator of the murder, in addition to premeditation, the aggravating circumstance of cruelty is contested, as, in the grip of an uncontainable homicidal fury, after having unloaded the entire magazine of the weapon, he raged on the victim, hitting him vehemently, repeatedly, on the head.
It is important to underline that the proceeding is in the preliminary investigation phase and that, following the execution of today's precautionary measure, there will be follow-up interrogation and discussion with the defense of the suspect, whose possible guilt, in relation to the alleged crimes , will have to be ascertained during the trial, in the cross-examination between the parties.
