Balestrate (Palermo), violates the restraining order and beats up his ex's new partner: 42-year-old arrested

The Carabinieri of the Station of Balestrate arrested a 42-year-old for the crime of violating the ban on approaching places frequented by the injured party.

In the circumstance, the attacker waited for his ex-partner near her home and when he saw that the woman was in the company of another manand he threw himself at the latter, attacking him with kicks and punches.

When the Carabinieri arrived the suspect had already disappeared, but the military acquired images from the video surveillance systems present and reconstructed the dynamics of the events in detail. Once the search was launched, late at night the military tracked down the attacker, thus carrying out the deferred arrest in flagrante delicto, as introduced by the recent legislation on the so-called "Red Code".

The arrest was validated by the Preliminary Investigations Judge of the Court of Palermo, who ordered the precautionary measure for the 42-year-old of house arrest with application of the electronic bracelet.

It is necessary to point out that the suspect is, at present, only accused of crime, albeit seriously, and that the position will be examined by the Judicial Authority throughout the entire procedural process e defined only following the possible issuing of a final conviction, in compliance with the constitutional principle of the presumption of innocence.
