Agrigento, restaurant closed for 3 days because it served drinks to its customers in the orange zone
Agrigento, during targeted police services, prepared by the Police Commissioner of the Province of Agrigento, aimed at verifying compliance with the Anti Covid-19 regulations, personnel of this Administrative Team together with the UPGSP - Flying section, at 20.00 pm on 07 May 2021 , carried out an inspection pursuant to art.13 of law 24/11/1981 nr.689, at a public food and drink establishment (BAR) located in Agrigento in via Atenea.
In the circumstance, it was found that the owner of the aforementioned commercial activity (BAR) sold drinks (alcoholic and super alcoholic) in plastic cups to various people (customers), who consumed what was first taken in a space in front of to the premises, creating a gathering and this in violation of the provisions for the containment of the COVID-19 epidemic in the "ORANGE AREA" which provides for the suspension of commercial activity from 18 pm to 00 am and the ban on gatherings of people in a public place or open to the public.
Therefore, we proceeded to issue 13 reports of complaints of administrative offense pursuant to Art 1 paragraph 8 of Legislative Decree no. 33 of 16/05/2020 (converted into law no. 74 of 14/07/2020) in relation to the art. 4 Legislative Decree of 25 March 2020, n° 19, converted into Law n° 35/2020.
In the same context, a report was raised alleging an administrative offense against the owner of the commercial activity pursuant to Art 1 paragraph 10 letter gg) of the Prime Ministerial Decree of 14/01/2021 in relation to the art. 4 Legislative Decree of 25 March 2020, n° 19, converted into Law n° 35/2020, the additional sanction of temporary closure for 3 days (THREE) was applied to public establishments (BAR).
