Smart working is extended until December 31st for fragile workers and parents with children up to 14 years old only in the private sector.
This is provided for in an amendment to the labor decree which was approved by the Social Affairs Committee of the Senate.
This was reported by the rapporteur of the measure Paola Mancini (FdI). For the public, however, "an in-depth investigation" is underway to verify the coverage and the decision will be made on Tuesday.
Within the first 12 months, fixed-term contracts can be not only extended but also renewed "freely", without the expected reasons; subsequently only with the reasons, provides for an amendment. At the moment, a fixed-term contract, within 12 months, can only be renewed if there are reasons, while it can be freely extended within the first year, but subsequently with the reasons. The change is not retroactive: for the calculation of the 12 months, in fact, only contracts stipulated after the entry into force of the decree are taken into account.
Total decontribution for 3 years for those who hire or stabilize carers who assist non-self-sufficient elderly people, according to the amendment. The change affects 2023, 2024, 2025 and foresees "a 100% exemption from contributions, up to a maximum amount of 3.000 euros per year, for 36 months, in the event of permanent hiring and transformation of domestic work contracts with assistant duties for a non-self-sufficient person over 65 years of age". The benefit is not available if a domestic work relationship between the worker and the employer ended less than 24 months ago.
The beneficiary of the inclusion allowance with children under 14 is required to accept a permanent offer only if within 80 km or reachable in 2 hours by public transport.
While the beneficiary “activable” at work is required to accept a permanent job offer with no distance limits, for the household with children under 14 years of age, "even if the parents are legally separated", the offer must be accepted if the job "does not exceed" 80 kilometers from home or "can be reached" within "120 minutes" by public transport.
For the fringe benefit the tax-free threshold remains set at 3 thousand euros only for employees with children. This was reported by parliamentary sources, who explain that the rule envisaged by the labor decree remains confirmed, while the exemption is also being considered for the contributory part, which would cost 190 million. During the work on the decree in the Social Affairs Committee of the Senate, the hypothesis of modifying the law emerged, while the orientation would be to intervene with an ad hoc provision starting from the proposal to bring the threshold to 1.000 euros for everyone plus a bonus of 660 euros per child.
The intervention, according to the amendment, establishes that for the period from 2023 June 21 to 2023 September 15, workers in the tourism sector, including spa establishments, are "recognised a sum by way of special supplementary treatment, which does not contribute to the formation of income, equal to XNUMX% of the gross wages paid in relation to night work and overtime work".
